የአብክመ ርዕሰ መስተዳድር ጽ/ቤት በፍኖተ ሰላም ከተማ የምክክር መድረክ
ማካሄዱን ጽ/ቤቱ አስታወቀ
የርዕሰ መስተዳድር ጽ/ቤት ኃላፊ የሆኑት አቶ ያየህ አዲስ እንደገለፁት በክልሉ ለሚገኙ ዞንና ወረዳ አስተዳደር ጽ/ቤቶች፣ የከተማ አስተዳደር ከንቲባ ጽ/ቤት ኃላፊዎች ጋር በ2009 ዓ.ም እቅድ ኦረንቴሽንና በመጀመሪያ ሩብ አመት ዕቅድ አፈፃፀም መስተዳድር ምክር ቤቱ ለህዝብ ጥቅም ሲባል ያስተላለፋቸውን ውሣኔዎች አስመልክቶ፣ እንዲሁም ለበርካታ ጊዜ በአንዳንድ ዞኖች የወረዳና የቀበሌ ይከፈልልኝ ጥያቄዎችን አስመልክቶ መስተዳድር ምክር ቤቱ 11 ወረዳዎችን እንዲከፈሉ የወሰነ ሲሆን የገንዘብ እንቅስቃሴን ከመምራትና ሥራ ማስጀመር የሚያስችል መዋቅር በየደረጃው ያለ የዞን አስተዳደር ጽ/ቤቱ ስራውን መስራት እንዳለበት ኃላፊው ጠቁመዋል፡፡
ኃላፊው አያይዘው እንደገለፅት ከጽ/ቤታችን ጋር ስራው በተቀላጠፈ መንገድ እንዲካሄድ የሚያስችሉ አጋር አካላት ወሣኝ ኩነቶች፣ ማህበረሰብ አቀፍ ጤና መድህን፣ ኢንፎርሜሽን ኮሚኒኬሽን፣ሠራተኛና ማህበራዊ ጉዳይ ስራዎችን በተሣለጠ መንገድ ለመስራት የሚያስችሉ በመሆናቸው ስለ ስራው የአሠራር ሂደት ሪፖርት በማቅረብ ውይይት መካሄዱን አስገንዝበዋል፡፡ ከዚህ በተጨማሪ በየደረጃው የሚገኙት የአስተዳደር ጽ/ቤቶች ግንኙነትን በተመለከተ የርዕሰ መስተዳድሩ የህግ ዋና አማካሪ ክቡር አቶ መርሃ ፅድቅ መኮነን ሰፋያለ ገለፃና ማብራሪያ ሰጥተዋል፡፡
በእለቱም የክልሉ የዳያሰፖራና ህዝብ ግንኙነት ዳይሬክተር የሆኑት አቶ አውላቸው ማስሬ በዲያስፖራ የአሠራር ሂደት ዞንና ወረዳዎች ዳያስፖራው ኢንቨስት ለማድረግ ሲመጡ መደረግ ያለበትን ቅድመ ዝግጅት አስመልክቶ ሪፖርታቸውን በማቅረብ ውይይት መካሄዱን ጠቁመዋል፡፡
በውይይቱ ወቅት አንዳንድ ተወያዬች እንደገለፁት ይህ መድረክ መካሄዱ በተለይ የርዕሰ መስተዳድሩን ተግባርና ኃላፊነት የተቋቋመበት አዋጅ የካቢኔ ሴክሬታሪያት ተግባርና ኃላፊነት፣የዳያስፖራ ጽ/ቤቱ መሰራት ያለበት ጉዳይ ምን እንደሆነ በግልፅ እንድንገነዘብ አድርጉናል በማለት ገልፀዋል፡፡ እንደዚህ አይነት የምክክርና የውይይት መድረኮች ተጠናክረው ቢቀጥሉ አቅም የሚፈጥሩ መሆናቸውን ጭምር አስተያየት ሰጥተዋል፡፡
The Emergence and Evolution of Intergovernmental Relations in Ethiopia: Processes, Institutional Arrangements and Structures in the Making By: Merhatsidk Mekonnen Abayneh Bahir Dar, Thursday, November 17 2016 1. >Introduction> This is a brief overview on the qualified status of intergovernmental relations (IGR) in the Federal Democratic Republic of Ethiopia, as they have been originating and taking shape in the context of our multi-level rule wherein power has to be exercised at more than one political levels of authority. The very genesis of ‘intergovernmental relations’ is as recent a phenomenon as the country’s official subscription to the federal system of governance. On this account, the IGR system in Ethiopia is still on an embryonic stage of development and utilization, primarily for lack of proper understanding and consensus on the part of the major actors and stake-holders concerned. It has yet to gain the necessary grasp and adequate attention, especially on the part of the top political leadership and its operational agents across the nation proper. 2. >Clarifying the Notion> In a federal political system, the entire sovereignty of state is constitutionally shared between the central authorities and the regional governments making up the federation .In spite of this power-sharing arrangement, however, these constituent units of the larger amalgam are bound to somehow coordinate and integrate their separate endeavors, should they wish to ultimately provide effective and quality services for their ordinary citizens.
In fact, parties to any federation have to work hard in strict harmony with one another if they are to achieve the overall national priorities and objectives, usually laid down in a common magna carta such as the federal constitution, so to speak. Certainly, they cannot make their broader wishes and fantasies a reality in a rather hostile, isolated and mutually exclusive actions, no matter how capable and resourceful they might be in their separate jurisdictions. It is because of this inherent deficiency that what is known as the ‘system of intergovernmental relations’ becomes necessary and even instrumental to integrate and smoothly manage the interface between and among the various constituent units. 3. >The Ethiopian Scenario in the Aftermath of the Federal Constitution> The formal incorporation of IGR in the 1995 FDRE’s Constitution isa rather vague and crude, to say the least. Admittedly, the House of Federation is mandated to arbitrate conflicts and misunderstandings that might arise between and among the regional states making up the Federal Republic, as has been stipulated under Art. 48 and Art. 62 Sub-Art. (6) Of the present constitution. Unfortunately, center-regional interactions and even possible hostilities are, however, accorded lesser treatment and gravity by the constitution, except fiscal relations regulated to a certain extent.
This is not to underestimate the established rule that a unified political and economic community has been envisaged or visualized by the federal constitution itself from the very outset as outlined in its preamble. Mention may also be made of the specific provisions laid down in Chapter ten of the constitution which clearly frame a set of key national policy objectives and principles. These multi-dimensional objectives and principles are essentially meant to guide the strategic and operational actions of both the federal and regional governments making it pretty mandatory for the desired system of intergovernmental relations and mechanisms to evolve and get institutionalized in due course.
4. >The Nature and Typology of Intergovernmental Relations and Structures in Place> By and large, the mainstream intergovernmental relations in any federation have both vertical and Horizontal Dimensions. Nevertheless, pretty much of the debate and controversy lies in the vertical relation between the center and the constituent sub nationals. This variant of intergovernmental relations is quite often characterized by a relentless competition and infighting over shared mandates and resources, among others. As a consequence, the kind of senseless tension across the federation would undermine the overall national development by gradually weakening the capacity of both the federal and regional governments which should have otherwise mobilized their combined energy in an active and collaborative manner in the best interest of the whole community. Hence, fairly and wisely regulating and managing the vertical interface between the two forces using a jointly negotiated and signed accord in the form of a policy or legal framework is recommendatory to make the entire system of governance function cohesively and effectively for the common good of all. Likewise, a comparable set of pre-determined mechanisms and procedures are of paramount importance to reliably facilitate and manage the exercise of horizontal intergovernmental relations involving the sub national units themselves, be they forged on a bilateral or multi-lateral basis. 5. >Absence of Formalization and Regularization> No formal intergovernmental relations and structures exist in present-day Ethiopia, regardless of its constitutional decentralization a couple of decades ago. Lacking this formalization and regularization on board, all sorts of inter-executive, inter-legislative and inter-sectoral constellations, periodic gatherings, consultative forums of dialogues and performance evaluation conferences flourishing across the country are simply nothing, but de facto intergovernmental mechanisms and venues of an informal and ad-hoc origin and development. In other words, they do not represent a legitimate and full-fledged machinery of permanent systems, processes and structures sustainable to the end. 6. >The Growing Need for an Enhanced Institutionalization of IGR mechanisms and processes currently taking shape in Ethiopia> The multi-level design and allocation of state powers and functions in a federation virtually requires that each and every constituent unit equally work for the consistent cooperation and coordination of isolated efforts with other spheres or levels/orders of government in an attempt to provide the citizenry with the desired services. In contemporary life, intergovernmental collaboration is more of practical necessity than philosophical underpinning. No government at any level can ever succeed in achieving its goals without the cooperation of its counterpart, be it at the center or sub-national jurisdictions.
The limited experience of our federal system of governance in Ethiopia today cannot, in any way, be an exception to the rule. That is why a dozen of inter-sectoral meetings are occasionally convened, usually on the initiation of the relevant federal ministries and commissions with a view to harmonizing strategic plans and priorities as well as evaluating performance reports. Unfortunately, the conspicuous absence of a comprehensive policy or legal framework governing the conduct of intergovernmental relations at the national level has so far enabled the federal government authorities alone to dominate the overall manipulation and operation of such periodic gatherings being hosted on a rotating basis. Due to this one-sided approach, the corresponding role of their regional counterparts on this regard is virtually reduced to the mere physical attendance of and participation in these meetings upon invitation extended to them by the senior officials of the central government. Nowadays, it is the ministers concerned, chief parliamentarians and the federal supreme court presidents, (not their counterparts at the level of regional states constituting the federation), whom we observe taking the upper hand in organizing and presiding over the periodic inter-sectoral gatherings. Of course, few of these gatherings have gradually transformed and solidified themselves a bit into consultative forums by setting up their own sectoral councils and secretariats as well as adopting operational byelaws at joint sessions in the absence of national regulatory framework on intergovernmental relations. 7. >How and Where to Proceed from Here?> Now that the first-hand survey conducted on the current status of our situation reveals a cross-section of practice-driven and center-dominated inter-sectoral forums, instrumentalities and procedures in the making, it is incumbent upon us as a union of federated states to revitalize the issue of intergovernmental relations on a new and elevated platform. With that aspiration in mind, it is hereby proposed that a draft national regulatory policy framework be first negotiated and agreed upon by a joint congregation involving all the heads of both the federal and regional governments’ branches across the country.
What should follow suit is the organization of the tripartite national executive, legislative and judicial intergovernmental councils or forums with their respective mandates of cross-cutting nature, not to be confused with those duties and responsibilities specifically entrusted upon them by the federal and regional constitutions alike. Furthermore, members of the councils/forums cited here-in-above need to be drawn from both the center and the constituent units making up the federation on an equal proportion with comparable rights and duties while at sessions.
The mainstream field of engagement for the proposed national councils/forums is likely to focus pre-dominantly on the management and facilitation of the vertical intergovernmental relations which is crucial to both the federal and regional states. The horizontal aspect of intergovernmental relations would, however, be the prime concern of those state parties wishing to interact between and among themselves on their own specific terms and conditions, provided that they are not involved in serious interregional disputes warranting federal intervention. > > ከ200 በላይ ለሚሆኑ በክልሉ በሚገኙ ዞኖችና ወረዳዎች እንዲሁም ከተማ አስተዳደሮች የተውጣጡ የቅሬታ መርማሪና አጣሪ ባለሙያዎች ከ22-27/7/2008 ዓ.ም በእንጅባራ ከተማ ለተከታታይ 6 ቀናት ስልጠና እንደተሰጠ የክልሉ የህዝብ ቅሬታ ሠሚ ኃላፊ አቶ ሰይድ እሸቴ ገልፀዋል፡፡ ሥልጠናውም በአማራ ብሔራዊ ክልላዊ መንግስት ለህዝብ ጥቅም ሲባል መሬታቸውን የሚለቁ የገጠር ባለ ይዞታዎችን መልሶ ለማቋቋም እና ይዞታቸውን ለማስተዳደር የወጣ ክልል መስተዳድር ምከር ቤት መመሪያ ቁጥር 26/2008 ዓ.ም አስመልክቶ ስለ መሬት ይዞታ ምዝገባ ወደ ሜትሮፖሉታን ከተማ የኘላንና የአስተዳደር ክልል የተጠቃለሉ የገጠር ቀበሌዎች መሬት ቆጠራና ምዝገባ ሥራን በተመለከተ የምዝገባ ስራ በከተማ ግብርና መመሪያ ጽ/ቤት በኩል እንደሚከናወንና በከተማ አስተዳደራዊና የኘላን ወሠንም ሆነ በከተማ ክልል ውጭ በልማት አስተዳደራዊና የኘላን ወሰን ሆነ በከተማ ክልል ውጭ በልማት ምክንያት ከመሬታቸው ለሚነሱ ባለ ይዞታዎች ትክ የሰፈራ፣ የእርሻም ሆነ የመኖሪያ ቤት መስሪያ ቦታ ስለሚዘጋጅበት አስመልክቶ በክልሉ የመሬት አጠቃቀምና አስተዳደር የህግ ባለሙያ የሆኑት አቶ አላዘር ማብራሪያ ሰጥተዋል፡፡ > |
የፈለገ ህይወት ሪፈራል ሆስፒታል ማስፋፊያ ሥራ መፈቀዱ ተገለጸ በአማራ ብሔራዊ ክልላዊ መንግሰት መስተዳድር ምክር ቤት አምስተኛ ዙር አንደኛ ዓመት የሥራ ዘመን መጋቢት 16/2008 ዓ.ም ባካሄደው አስራ አምስተኛ መደበኛ ስብሰባ የፈለገ ህይወት ሪፈራል ሆስፒታል የማስፋፊያ ግንባታ አስፈላጊ በመሆኑ መፈቀዱን ገለፀ፡፡ ውይይቱ የተጀመረው የጤና ጥበቃ ቢሮ ኃላፊው የኢኮኖሚ ልማት ጉዳዩች ቋሚ ኮሚቴን የውሣኔ ሃሣብ በንባብ ለምክር ቤቱ በማሠማት ሲሆን ቋሚ ኮሚቴው አስሪው መስሪያ ቤትና አማካሪ ድርጅቱ ከሰጡአቸው ማብራሪያዎች በመነሳት በጉዳዩ ላይ በስፋት በመወያየት የማስፋፊያው ግንባታው ከዲዛይኑ ጀምሮ የተሄደበት አግባብ የኮንሰትራክሽን አስተዳደሩን የተከተለ ባይሆንም የሆስፒታሉን ደረጃና አገልግሎት አሰጣጥ ከማሳደግ አንፃር ውሣኔ የሚያስፈልጋቸውና ሊስተካከሉ ይገባል ያላቸውን ነጥቦች በዝርዝር አቅርበው የኮሚቴውን የውሣኔ ሀሣብ አጠቃለዋል፡፡ በዚህም መሠረት ምክር ቤቱ በጉዳዩ ላይ የተለያዩ አስተያየቶችን በማንሣት በስፋት ከተወያየ በኃላ የማስፋፊያ ግንባታው የሆሰፒታሉን ደረጃና አገልግሎት አሰጣጥ ከማሣደግ አንፃር ታስቦ እየተሠራ ያለ መሆኑን በመውሰድ፣ሆኖም ግን ግንባታው ከዲዛይኑ ጀምሮ የተሄደበት አግባብ የኮንስትራክሽን አስተዳደሩን የተከተለ አለመሆኑንና አሰሪው መስሪያቤትም የማስፋፊያ ግንባታ ሥራው የተጀመረ በመሆኑ ካላው ችግር አኳያ በአጭር ጊዜ ተጠናቆ አገልገሎት መስጠት ሥለአለበት የሁለቱም ብሎኮች ግንባታ IPD (ከG+5 ወደ G+6) and OPD (ከG+4) BLOCK በተጀመረበት አግባብ እንዲቀጥል ቋሚ ኮሚቴው ባቀረበው የውሣኔ ሀሣብ በመስማማት፣ከዲዛይን፣ ከተጨማሪ ስራና በጀት እንዲሁም ተያያዥ ጉዳዩች አንፃር ውሣኔ የሚያስፈልጋቸውና ሊስተካከሉ ይገባል ያላቸውን ነጥቦች፦
· >በአማካሪው ድርጅት የተሠራው ዲዛይን በህንፃ ሹም ያልፀደቀ በመሆኑ አማካሪው ድርጅት ውል ገብቶ ዲዛይኑን ለህንፃ ሹም አቅርቦ እንዲያፀድቅ፣ IPD (G+6) BLOCK ግንባታን በተመለከተ ምክር ቤቱ ከG+5 ወደ G+6 ተቀይሮ እንዲሠራ በቀረበው ውሣኔ መሠረት በመስማማት ሥራው ገና ከG+1 በታች በመሆኑ የግንባታ ሥራው እየተሠራ ጐን ለጐን የተሰራው ዲዛይን በከተማ ልማት ቤቶች ኮንሰትራክሽን ቢሮ በ1 ወር ጊዜ ውስጥ የተሠራውን ዲዛይን መጠን አረጋግጦ እንዲያቀርብና በቀረበው የመጠን ልዩነት መሠረት የባሬሺን ውል እየተያዘ ስራው ግንባታውን እያከናወነ ባለው ተቋራጭ እንዲቀጥል እንዲደረግ ምክር ቤቱ ወስኗል፡፡> ለታሣቢ ጥብቅ ስፍራዎች ህጋዊ ሰውነት እንዲሰጥ መወሰኑ ተገለጸ የአማራ ብሔራዊ ክልላዊ መንግስት መስተዳድር ምክር ቤት አምስተኛ ዙር አንደኛ ዓመት የሥራ ዘመን የካቲት 18 ቀን 2008 ዓ.ም ባካሄደው 14ኛ መደበኛ ስብሰባ ለታሣቢ ጥብቅ ስፍራዎች ህጋዊ ሰውነት እንዲሰጥ የቀረቡ ቦታዎች የጉና፣የአቡነ ዩሴፍ ዝጊትና አቦይ ጋራ ተራራዎች የማህበረሰብ ጥብቅ ስፍራዎች ዳር ድንበር እንዲከለሉ ተወሰነ፡፡ የአካባቢ፣የደን እና ዱር አራዊት ጥበቃና ልማት ባለሥልጣን ስራ አስኪያጅ ባቀረቡት ማብራሪያ ሲሆን በመጀመሪያ ደረጃ የጉና ተራራ የማህበረሰብ ጥብቅ ስፍራ ራሱን የቻለ ደንብ ወጥቶለት በጥብቅ ስፍራነት ተከልሎ እንዲተዳደር መደረጉ በተራራው እየታየ ያለውን የብዝሃ ሕይወት መመናመን ለመከላከል፣ተራራው በዘላቂነት ልማት ሊያበረክት የሚችለውን አቅም ለማስቀጠል ከተራራው ጋር በቀጥታም ሆነ በተዘዋዋሪ ተጠቃሚ የሆነውን ህብረተሰብ በዘላቂነት ኢኮኖሚያዊ ጥቅም እንዲያገኝ ለማስቻል፣የአእዋፍና የእፅዋት ዝርያዎችን ባሉበት ለመጠበቅ ብሎም ሀገራችን ለምትከተለው የአረንዷዴ ኢኮኖሚ ልማት ፖሊሲ አጋዥ ሚና ያለው በመሆኑ አሰራሩን በህግ ለመደገፍ የደንቡ መውጣት አስፈላጊና ተገቢ መሆኑን ላይ በመስማማት በሁለተኛ ደረጃ የቀረቡት የአቡነ ዮሴፍ፣ ዝጊትሃ አቦይ ጋራ ተራራዎች የማህበረሰብ ጥብቅ ስፍራ ዳር ድንበር አከላለልና አስተዳደር መወሰኛ ረቂቅ ደንብ የውሣኔ ሀሣብ ሲሆን ኮሚቴውም በአጀንዳው ላይ በስፋት ከተወያየ በኃላ ጥብቅ ስፍራው ከጉና ተራራ ጋር የቦታ ለውጥ ካልሆነ በስተቀር ተመሣሳሳይ ስነ-ምህዳር ያላቸውና ደንቡም በተመሣሣይ የተዘጋጀ ስለሆነ ከላይ የተጠቀሱት ማስተካከያ ሀሣቦች በዚህ ደንብ ላይም በተመሣሣይ ተካተው ለመስተዳድር ምከር ቤቱ ቀርቦ እንዲፀድቅ ኮሚቴው የውሳኔ ሀሣቦች ማቅረቡን አስረድተዋል፡፡
በዚህም መሠረት መስተዳድር ምክር ቤቱ የህግና አስተዳደር ቋሚ ኮሚቴ ከቀረበው የውሣኔ ሀሣብ ላይ በመነሳት በአጀንዳው ላይ በስፋት ከተወያየ በኃላ ሁለቱም ቦታዎች ለአካባቢው ማህበረሰብ ኢኮኖሚ ልማት ከፍተኛ ፋይዳ ያላቸውና ወደ ፊት ብዝሃ-ሕይወታቸው እየተጠበቀ ለአካባቢው ዘላቂ ልማት የበለጠ ጠቀሜታ እንዲኖራቸው ለማስቻል አካባቢዎቹን በህግ መከለልና ማስተዳደር እንደሚገባ በማመን የቀረቡት ደንቦች በቋሚ ኮሚቴው የውሣኔ ሀሣብና በተሰጡት ማስተካከያዎች መሠረት ተስተካክለው የምከር ቤቱ ደንቦች ሆነው እንዲወጡ ም/ቤቱ በሙሉ ድምፅ ወስኗል፡፡ |
